The bill (Reg. No.7144), submitted by the Cabinet of Ministers of Ukraine, improves legal regulation of civil aviation, taking into account the modern technical level of aircraft engineering, and incorporating the requirements of the international organization on flight navigation security and passenger´s rights into the legislation of Ukraine.
The Committee members agreed to the necessity of legislative regulation of civil aviation, in particular, its harmonization with the norms of the international and European Laws on civil aviation.
However, the People´s Deputies claimed that the bill lacked juridical, technical and professional terms, and several clauses on civil aviation. The parliamentarians are convinced that the norms of the bill regulating the passenger´s rights protection have been drafted in an unsatisfactory manner.
The People´s Deputies expressed remarks concerning the principles of the state supervision in the sphere of service quality standards, protection of passenger´s rights and rendering of these services.
Adjusting the bill to the second reading, the proposals on the legislative consolidation of passenger service standards according to the classes (business, premium and economic classes) on international and domestic flights should be considered.
The People´s Deputies also suggest taking into consideration the proposal of legislative consolidation of air carriers´ liability for the death, inflicted harm, loss of baggage, delay in its delivery and delay of flights on the domestic flights, in accordance with the European standards and norms.
The Committee members believe that the draft Air Code of Ukraine can be adopted as a basis, taking into consideration the remarks and proposals expressed in the course of its adjustment to the second reading.
